Reporting copyright infringement
Auramin LTD respects the intellectual property rights of others. We respond to notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act (“DMCA”), 17 U.S.C. § 512, and other applicable laws. Our response may include removing or disabling access to the material, and ending our cooperation with the creator or provider of that material.
Only the copyright owner, or an agent authorized to act on the owner's behalf, should file a notice. Notices and counter-notices must be written in English; notices in other languages may be treated as incomplete.
Filing a notice
Filing a notice starts a legal process, so please make sure your claim is accurate. The quickest way is our DMCA takedown form, which asks for everything we need to find and review the material.
You can also send a written notice to our designated agent. It must include substantially the following:
- identification of the copyrighted work you believe has been infringed or, for several works, a representative list;
- identification of the infringing material precise enough for us to locate it. Please give the URL of each exact video page; a creator name or a general page is usually not enough;
- your name, postal address, telephone number and email address, so that we and the provider of the material can contact you;
- a statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent or the law;
- a statement that the information in the notice is accurate and, under penalty of perjury, that you are the owner, or are authorized to act on behalf of the owner, of an exclusive right that is allegedly infringed;
- your physical or electronic signature. Typing your full legal name at the end of the notice is accepted as an electronic signature.
A notice that does not substantially meet the requirements of 17 U.S.C. § 512(c)(3) may not be effective.
Designated agent
Send written notices and counter-notices to:
DMCA Agent, Auramin LTDAgias Elenis 4, Michaelides Building, Floor 1, Flat 104, Nicosia, 1060, Nicosia, Cyprus
Email: [email protected]
Please send only DMCA notices and counter-notices to this address. Unless we have agreed otherwise in writing, our designated agent is not authorized to accept or waive service of legal process. Other questions can be sent to [email protected].
What happens after a notice
When we receive a complete notice, we act promptly to remove or disable access to the material and take reasonable steps to inform the creator or provider of the material, so that they can file a counter-notice if they believe the removal was a mistake. We keep a record of the notices we act on.
Your notice, including your name and contact details, may be forwarded to the creator or provider of the material. By sending a notice, you agree to this.
Counter-notices
If material you provided was removed or disabled because of a notice and you believe this happened by mistake or misidentification, you, or an agent authorized to act for you, may send a counter-notice to our designated agent. It must include substantially the following:
- your name, address, telephone number and physical or electronic signature;
- identification of the material that was removed or disabled, and where it appeared before;
- a statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification;
- a statement that you consent to the jurisdiction of the U.S. federal district court for the judicial district where your address is located (or, if your address is outside the United States, any judicial district in which Auramin LTD may be found), and that you will accept service of process from the person who sent the original notice or that person's agent.
We do not act on counter-notices that do not meet these requirements. When we receive a valid counter-notice, we forward it, including your personal information, to the person who sent the original notice, and tell them that the material may be restored in no less than 10 and no more than 14 business days, unless our designated agent first receives notice that they have filed a court action to restrain the alleged infringement. We share counter-notices only with the original claimant, law enforcement or those who help us protect our rights.
Repeat infringers
In appropriate circumstances and at our discretion, we stop publishing material from, and end our cooperation with, creators and providers who are found to be repeat infringers. We may also do so after a single infringement.
Misrepresentations
Under 17 U.S.C. § 512(f), anyone who knowingly materially misrepresents that material is infringing, or that it was removed or disabled by mistake or misidentification, may be liable for damages, including costs and attorneys' fees. Please consider whether the use could be a fair use before filing a notice.
